Fair Housing Initiatives Program Enforcement Testing Technical Assistance

To assist private and tax exempt fair housing enforcement organizations in the investigation and enforcement of all alleged violations.

To develop, and implement tester training, and enforcement under the Fair Housing Act; 42 U.S.C.

3601-3619 or State or local laws that provide substantially
equivalent rights and remedies for alleged discriminatory housing practices.

Objectives also include providing tester guidance and other investigative activities.

Uses and Use Restrictions

Training of all organizations carrying out fair housing testing and testing activities.

Eligibility Requirements

Applicant Eligibility

Organizations with the capability to provide training and have knowledge of testing and testing methodologies.

Non-profit tax exempt organization with at least three years of experience in training of large groups.

Beneficiary Eligibility

Qualified fair housing enforcement organizations and fair housing enforcement organizations and others interested in conducing fair housing testing.

Credentials/Documentation

Beneficiaries and applicants for funding of testing activities must certify that they will not solicit funds from or seek to provide services or products for compensation to any person or organization which has been the subject of testing by the applicant for a 12-month period following a test. Also, their testing methodology must be approved by HUD before being implemented. OMB Circular No. A-87 applies to this program.

Application Procedures

This program is excluded from coverage under OMB Circular No. A-102. OMB Circular No. A-110 applies to this program. Applications must be submitted in accordance with requirements and forms provided in the Notice of Funding Availability as published in the Federal Register.

Award Procedures

Applications will be evaluated competitively and awarded points based on the Selection Criteria included in the published Notice of Funding Availability. The final decision rests with the Assistant Secretary for Fair Housing and Equal Opportunity or her/his designee.

Audits

In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $500,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.
